HEMP RESTRICTIONS

  • Hemp Pre-Rolls <0.3% THC: Illegal

  • Hemp Cigar Papers: Restrictions on Sale
  • Notes on hemp restrictions: An out-of-state operation does not need to have an Idaho license to sell hemp in Idaho, provided that the operation is licensed through the USDA or another state program. All manufactured hemp products sold in Idaho must have a THC concentration of 0.0%. All hemp or CBD products in Idaho must be derived from either: (a) the mature stalks of the hemp plant; (b) fiber produced from the stalks; (c) oil or cake make from the seeds or the achene of the hemp plant; (d) any other compound, manufacture, salt, derivative, mixture, or preparation of the mature stalks; or (e) the sterilized seed of the hemp plant which is incapable of termination. The sale of rolling papers of any kind to individuals under the age of 21 is prohibited. FDA and FTC labelling requirements apply to CBD products.
